Terms of Service

These terms govern your use of Dayloom. They're written to be straightforward — the short version is: use the app for what it's for, respect the IP, and we'll do our best to keep it working well.

1. Who we are

Dayloom (the "App") is published by Malave.Tech LLC, a New York limited liability company ("we," "us," "our"). By downloading, installing, or using Dayloom, you ("you," "user") agree to these Terms of Service ("Terms").

2. License to use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use Dayloom on Apple devices you own or control, solely for your personal, non-commercial purposes.

This license is in addition to the Apple Licensed Application End User License Agreement, which also applies to your use of the App.

3. Your content

Anything you write in Dayloom — entries, notes, threads — is your content. You own it. We do not claim any rights to it, and we cannot read it (see our Privacy Policy for how on-device storage and optional iCloud sync work).

Because your content lives on your device, you are responsible for backing it up. We recommend enabling iCloud sync or using your device's standard backup tools.

4. What you agree not to do

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law.
  • Use the App in violation of any applicable law or regulation.
  • Use the App in any way that could damage, disable, or impair its operation or interfere with other users' use of it.
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices.

5. Intellectual property

The App, including its name, logo, design, code, and the Dayloom brand mark (the woven calendar), is owned by Malave.Tech LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without our written permission.

6. Disclaimers

Dayloom is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or that any defect will be corrected. While we make every effort to keep your data safe, we cannot guarantee against data loss caused by device failure, software bugs, or other circumstances. Keep your own backups.

7. Limitation of liability

To the maximum extent permitted by law, Malave.Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or related to your use of the App. Our total liability for any claim arising out of or related to these Terms or the App will not exceed the amount you paid us for the App in the twelve months preceding the claim, or, if no payment was made, fifty US dollars ($50).

8. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you violate these Terms or if continued operation of the App becomes impractical. Sections that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) will survive.

9. Changes to the App or these Terms

We may update the App from time to time, including adding, changing, or removing features. We may also revise these Terms; if we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated within the App or by other reasonable means before they take effect. Continuing to use the App after a change means you accept the revised Terms.

10. Governing law & dispute resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the App will be brought in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
